    After more than a year I have now found a buyer but the tenant will not allow the surveyor to view inside the house so the buyer’s mortgage application can be approved. I am desperately worried the sale will fall through. What can I do? O.M., London
    A tenant does have significant rights under law to ‘quiet enjoyment’ and ‘the right to exclude all others.’ But continuously denying reasonable access means you could have a problem. In this case, your tenant is probably concerned they will be evicted if you sell the house. Presuming your potential buyer wants vacant possession, this will be the case. If negotiations have broken down, then unfortunately you will have to begin possession proceedings, usually by serving a Section 21 Notice. But if you require immediate access, then a court injunction is the only route. But be warned: it is possible a judge may not grant the injunction in a non-life threatening situation (i.e. no gas leak or fire safety risk). You may have to wait for the p…
